Man who spent 17 years in jail for rape he didn’t commit has conviction overturned

man who served 17 years in jail for a rape he didn’t commit has been cleared by the Courtroom of Attraction.

Andrew Malkinson, 57, was discovered responsible of raping a girl in Better Manchester in 2003 and the next 12 months he was jailed for all times with a minimal time period of seven years.

Nonetheless, his barrister Edward Henry KC instructed the courtroom on Wednesday that as a result of he maintained he was harmless and “wouldn’t falsely confess to abhorrent crimes which he didn’t commit”, Mr Malkinson served an additional 10 years in jail after his tariff expired.

Mr Malkinson had been preventing to clear his identify and his case was referred to the courtroom in January by the Legal Instances Evaluation Fee (CCRC), which investigates potential miscarriages of justice.

Not too long ago-obtained DNA proof had linked one other potential suspect to the crime.
